1. Introduction
Welcome to Quiz Thrive, an educational quiz application developed and operated by GetThrive Digital Solutions Private Limited ("Company," "we," "our," or "us") whose registered / operational office is #90, 2nd main road, kalyan layout, nagadevanahalli, mallathahalli, bangalore south Bengaluru KARNATAKA 560056. By accessing or using our application ("Quiz Thrive APP / quizthrive.com") and services ("Quiz Mock Test, Quiz Competition, Scholarship Program & Advertising in App"), you ("User," "you," or "your") agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before using our App and Services. If you do not agree with these Terms, you must not use our App or Services.
2. Eligibility
2.1 Age Requirement: To use our Services, you must be at least 13 years old. Users under 13 ("Minors") may use the Services only with the consent and supervision of a parent or legal guardian. By allowing a Minor to use the Services, the parent or legal guardian agrees to be bound by these Terms and is responsible for the Minor's activities on the App.
2.2 Jurisdiction: Our Services are intended for users residing in India. Accessing the App from territories where its content is illegal or restricted is prohibited.
3. User Registration and Account
3.1 Account Creation: To access certain features, you may need to create an account by providing accurate and complete information, including your name, email address, and other required details. You agree to update your information to keep it accurate and complete.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.
3.3 Multiple Accounts: You may not create multiple accounts for fraudulent purposes or misuse the Services. Each user is allowed only one account unless otherwise permitted by us.
4. Services Offered
4.1 Mock Tests: We provide mock tests for various competitive exams in India, such as CET, JEE, and NEET. These tests simulate real exam conditions to help users prepare effectively.
4.2 Scholarship Exams: We conduct scholarship exams where users pay an entry fee to participate. The collected fees are pooled, with 80% allocated as scholarships to top performers and 20% retained by the Company as a platform fee.
4.3 General Quizzes: In addition to exam-specific tests, we offer quizzes on general knowledge, mathematics, and other subjects to cater to a broader audience.
4.4 Rewards Program: To encourage learning, we reward users with Cash / Reward Token, based on their performance and engagement on the App.
5. Payments and Fees
5.1 Mock Test Fees: Users may be required to pay a fee to access certain mock tests. The fee amount will be specified within the App.
5.2 Scholarship Exam Entry Fees: Participation in scholarship exams requires payment of an entry fee, the amount of which will be specified within the App.
5.3 Platform Fee: The Company retains 30% of the total pooled entry fees from scholarship exams as a platform fee. The remaining 70% is distributed as scholarships to eligible users.
5.4 Payment Methods: We accept payments through various methods, including credit/debit cards, net banking, and other digital payment options. All payments must be made in Indian Rupees (INR).
5.5 Refund Policy: Fees paid for mock tests and scholarship exams are non-refundable, except in cases where the Service is not provided due to technical issues attributable to us. Refund requests must be submitted within 7 days of the transaction.
6. Use of Reward Tokens
6.1 Earning Reward Tokens: Users can earn Reward Tokens through various activities on the App, such as completing quizzes, achieving high scores, and participating in promotional events.
6.2 Redeeming Reward Tokens: Reward Tokens can be redeemed for rewards as specified within the App. The redemption options and required Reward Tokens amounts are subject to change at our discretion.
6.3 Reward Tokens Wallet: Each user will have a digital wallet within the App to manage their Reward Tokens balance. The wallet is non-transferable and can only be used within the App.
6.4 No Monetary Value: Reward Tokens is a digital reward token with no monetary value outside the App. It cannot be exchanged for cash or any other currency.
7. User Conduct
7.1 Prohibited Activities: You agree not to:
Violate any applicable laws or regulations.
Engage in fraudulent, deceptive, or misleading practices.
Infringe upon our intellectual property rights or those of others.
Disrupt or interfere with the operation of the App or Services.
Attempt to gain unauthorized access to our systems or data.
Post or transmit harmful, offensive, or inappropriate content.
7.2 User-Generated Content: If you submit or post content on the App, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and display such content. You are responsible for ensuring that your content does not violate any laws or infringe upon third-party rights.
8. Intellectual Property Rights
8.1 Ownership: All content, features, and functionality on the App, including text, graphics, logos, and software, are the exclusive property of the Company or its licensors and are protected by intellectual property laws.
8.2 Limited License: We grant you a limited, non-exclusive, and non-transferable license to access and use the App for personal and educational purposes, subject to these Terms.
8.3 Restrictions: You may not reproduce, distribute, modify, or create derivative works of any content on the App without our prior written consent.
9. Disclaimers and Limitation of Liability
9.1 No Warranty: The App and Services are provided "as is" without any warranties, express or implied. We do not guarantee the accuracy, completeness, or reliability of any content on the App.
9.2 Limitation of Liability: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App or Services.
9.3 Third-Party Links: The App may contain links to third-party websites or services. We are not responsible for the content or practices of these third parties.
10. Termination
10.1 Termination by You: You may terminate your account at any time by contacting us or using the account deletion feature within the App or Contact Us.
10.2 Termination by Us: We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that harms the Company or other users.
10.3 Effect of Termination: Upon termination, your right to use the App and Services will cease immediately. Any accrued rights and obligations will survive termination.
11. Modifications to Terms
We may update these Terms from time to time. Changes will be effective upon posting the revised Terms on the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
12. Governing Law and Dispute Resolution
12.1 Governing Law: These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
